PROVISION OF SERVICES
The Photo2Go agrees to provide services in accordance with the Client's specific and reasonable instructions. The Photo2Go will use high-quality digital equipment and materials to fulfill the Client’s expectations for both print and media photographic purposes. While every effort will be made to achieve the desired outcomes, the Photo2Go cannot guarantee specific results. The Company is not liable for any interference or ruined photographs caused by external factors, such as guests' flashes or other uncontrollable circumstances.
PAYMENT TERMS
A deposit of $300 is required at the time of signing the Agreement. Read more outlined in the LIMIT OF LIABILITY section. The remaining balance must be paid in full no later than four week prior to the Event. Payments are to be made via bank transfer, debit/credit card, or other mutually agreed-upon methods.
If the Client requests additional photo booth usage beyond the agreed-upon time, the Photo2Go may, at its sole discretion, agree to such a request for an additional hourly fee of $100, payable at the end of the extended session. If the Client fails to pay the additional fees on time, the Photo2Go Booth will withhold any deliverables until all fees are settled.
COOPERATION AND COMMUNICATION
Both Parties agree to maintain a positive and cooperative relationship to ensure the best possible outcome of the services. The Client is encouraged to designate an individual familiar with most attendees to assist the Photo2Go with identifying key persons during the event. The Client must provide sufficient notice of significant activities during the Event. If adequate notice is not given, the Photo2Go cannot be held responsible for any missed photo booth opportunities. Additionally, the Photo2Go recognizes that some individuals may not wish to have their photographs taken, and in such cases, discretion will be used.
VENUE AND LOCATION CONSTRAINTS
The Client acknowledges that the Photo2Go ability to perform services may be limited by the rules and regulations of the event venue. The Client accepts any resulting technical limitations. Any changes to venue restrictions or rules must be negotiated directly with the venue management, and the Photo2Go will only provide technical recommendations.
PERMITS
It is the Client’s responsibility to obtain any necessary permits or permissions for the location(s) where the Photo2Go will perform its services.
ACCESS, SPACE, AND POWER REQUIREMENTS
The Client will provide adequate space for the Photo Booth at the event venue 3mx3m. The Client is also responsible for ensuring access to power (240v Standard AU power) for each Photo Booth.
INTERNET CONNECTIVITY
The Client is responsible for ensuring that the event venue has sufficient internet connectivity. If the venue does not provide adequate signal, the Client may arrange for a private Wi-Fi connection. The Photo2Go may offer 4G mobile broadband if signal strength permits. The Photo2Go cannot be held responsible for any service disruptions due to poor internet connectivity or technical issues.
CANCELLATION POLICY
The Reservation Deposit is non-refundable. However, the Client may reschedule the Event or transfer the reservation to a different date, subject to selecting a package of equal or higher value. If the cancellation is due to the Photo2Go inability to provide services, the Client will receive a full refund, including the deposit, within seven days.
DATE CHANGES
Requests for a change of date must be made in writing at least 28 days before the original Event date. Changes are subject to availability and may require a new booking contract. If the requested date is unavailable, the deposit may be forfeited, and the event will be canceled.
LIMITATION OF LIABILITY
In the event that the Photo2Go is unable to perform its services due to unforeseen circumstances such as illness, or other factors beyond its control, the Photo2Go will attempt to find a suitable replacement. If a replacement is not found, the Client’s sole remedy will be the return of all payments received for the Event. Similarly, if digital files are lost or destroyed due to technical issues, the Photo2Go liability is limited to the refund of all payments received.
APPLICABLE LAW
This Agreement will be governed by the laws of Australia, and any legal action related to this Agreement must be brought in a court with appropriate jurisdiction in Victoria.
HEADINGS
Headings are for reference purposes only and do not affect the meaning of any provision in this Agreement.
Hiring, delivery & service
The delivery, setup, and removal of equipment are provided at no additional cost. Please note that the time spent on delivery, setup, and removal will not be included within the rental period. The booth attendant is scheduled to arrive approximately one hour before the rental time to ensure proper setup. Throughout the event, the attendant will remain nearby to oversee the smooth operation of the equipment. The hirer is responsible for any damage to the equipment during the rental period.
Use of images
By hiring from Photo2Go, the hirer grants permission for images taken at the event to be featured on the Photo2Go website and used for promotional purposes, unless the hirer informs us in advance that they do not wish for their images to be used. Photo2Go will ensure that only appropriate images are used for advertising, and any content deemed unsuitable or potentially harmful to any individual will not be published.
Miscellaneous
The Photo2Go operator reserves the right to halt usage of the equipment at any point during the event if they believe it is being used in a manner that could pose a risk to individuals or cause potential damage to the equipment.
